1. GENERAL TERMS AND CONDITIONS
1.1. Preamble
Cultival (hereinafter “Cultival”) is a French simplified joint-stock company, with share capital of €72,099.83, whose registered office is located at 1 rue de Gramont, 75002 Paris, France, registered under number 429 945 447 with the Paris Trade and Companies Register. The intra-Community VAT number is FR96 429 945 447.
Cultival is responsible for ticket sales for the Salon Les Nouveaux Ensembliers.
1.2. Purpose of the contract
These terms and conditions define the terms and conditions of access to the offers and services provided to Clients by Cultival for Manufactures nationales, Sèvres & Mobilier national.
Accordingly, any order placed by the Client implies their prior acceptance, without reservation, and full and complete adherence to these general terms and conditions, which take precedence over any other document, except in the case of special terms expressly agreed in writing by Cultival.
These terms are governed by French law. They cancel and replace all previous versions and may be modified at any time by Cultival, without prior notice. Such modifications will not apply to orders already accepted and confirmed by Cultival.
The general terms applicable to an order are those accepted by the Client at the time the order is placed. Any dispute relating to these terms which cannot be settled amicably will be submitted to the French courts.
1.3. Definitions
The following terms shall have the meanings set out below:
Client: person who purchases a Service or product from Cultival, whether for personal use or to offer to a Beneficiary.
Beneficiary: person who benefits from the Service.
Service: event provided by Cultival to the Beneficiary, in this case, admission to the Salon Les Nouveaux Ensembliers.
Ticket: ticket(s) granting access to the Service.
Venue: the location of the Service, in this case, the Galerie des Gobelins.
1.4. Ticket
Cultival issues Tickets for the Salon Les Nouveaux Ensembliers. The Ticket contains the order reference details: order number, order date, Client name, date, name and location of the Service, and a QR code for access control. A ticket may be valid for multiple Clients; in such cases, the number of people is indicated.
Tickets are sent only after full payment has been received. Only visitors holding a Ticket will be admitted to the Service.
1.5. Accuracy of information
It is the Client’s responsibility to check that the information on the Ticket matches what was actually ordered (date, time of Service, number of seats, etc.) within one hour of placing the order. In case of discrepancies, the Client must notify Cultival by email at ensembliers@cultival.fr within one hour of placing the order. For orders placed less than one hour before the Service, any discrepancies must be reported before the Service takes place. No claims will be accepted after the Service.
1.6. Prices
Prices displayed in commercial documents and on the website www.salon-des-nouveaux-ensembliers.fr are in euros, VAT included. Prices may be revised at any time. The applicable rate is the one in effect on the website on the date the final order is placed.

The booking becomes final upon receipt of payment.
1.8. Reduced mobility
The Galerie des Gobelins is accessible to persons with reduced mobility.
1.9. Payment method
Only payment by credit card is accepted on www.salon-des-nouveaux-ensembliers.fr
1.10. Ticket delivery by email
Fees: by email – no charge.
1.11. Delivery times
Email: immediate. It is the Client’s responsibility to ensure that the Ticket is received and to notify Cultival if not. Cultival cannot be held responsible if the Client is unable to attend the Service because they did not inform Cultival in advance of non-receipt of the Ticket.
1.12. Force majeure
A case of force majeure or fortuitous event is any external, unforeseeable and irresistible event within the meaning of Article 1148 of the French Civil Code, beyond Cultival’s control, that prevents the fulfilment of the services sold. This includes acts of public authority, hostilities, wars, riots, acts of government, natural disasters, pandemics and health crises, fires, floods, exceptional weather conditions, failures or delays of suppliers, subcontractors or carriers, breakdowns, telecommunications or internet outages, interruptions in transport, energy or raw material supply, etc.
Any party wishing to invoke force majeure must immediately notify the other party of the start and end of the event, failing which they may not be relieved of their obligations.
1.13. Right of withdrawal
Under applicable law for distance contracts, the consumer Client who purchases a good or service has 14 days to change their mind without having to justify the decision or pay penalties (except possible return costs).
However, under current regulations, the right of withdrawal does not apply to contracts for services relating to accommodation, transport, catering, or leisure activities provided on a specific date or according to a fixed schedule. As such, Cultival’s Services are not subject to this right.
1.14. Insurance and liability
Cultival has taken out professional liability insurance with a leading insurer. The Client is responsible for any damage caused by them and is therefore advised to take out personal liability insurance.
1.15. Governing law – disputes
Any complaint about a Service must be sent to Cultival within 72 business hours after the Service, by registered mail only. In the event of an unresolved dispute, the matter may be submitted to Cultival, which will attempt to reach an amicable settlement. Any dispute relating to these terms shall be subject to the exclusive jurisdiction of the French courts.
After contacting customer service (contact@cultival.fr) and in the absence of a satisfactory response within 60 days, the Client may refer the matter free of charge to the Tourism and Travel Mediator (www.mtv.travel).

1.16. Personal data and cookies
Cultival respects Client privacy and complies with applicable personal data protection laws. Cultival may collect personal data when Clients place orders. Details of Cultival’s personal data policy are available in the “Personal Data” section of the website.
Cultival uses cookies to improve the browsing experience. Details of the cookie policy are available in the “Cookies” section of the website. Clients may register on the Bloctel list to opt out of telemarketing calls.
2. SPECIAL TERMS FOR THE SALON LES NOUVEAUX ENSEMBLIERS
2.1. Preamble
These special terms apply exclusively to the Salon Les Nouveaux Ensembliers (the “Salon”) and supplement the general terms in Section 1. In the event of a conflict between the two, these special terms shall prevail.
2.2. Booking
The experience takes place in time slots listed on www.salon-des-nouveaux-ensembliers.fr.
Booking is mandatory; tickets cannot be purchased at the Venue (no on-site ticket office). Beneficiaries must present their ticket on the day of the Service.
2.3. Mandatory contact information
When booking, the Client must provide a phone number or email address so that Cultival can contact them in case of changes to the meeting point or cancellation of a time slot.
It is the Client’s responsibility to check for any messages from Cultival before their time slot. Cultival cannot be held responsible if the Client has not provided contact details or has not checked their messages. In such cases, no compensation will be granted.
2.4. Practical information
It is the visitor’s responsibility to review practical information about the Venue and the Salon (meeting point, arrival time, restrictions, entry procedures, etc.) as stated on the product page, on the ticket, and in pre-event emails. Cultival cannot be held responsible for any consequences arising from failure to review this information.
2.5. Timeliness and late arrival
The meeting time on the Ticket must be strictly respected. This time is different from the start time of the session and allows for security checks. The Client is responsible for planning travel to arrive on time.
Late arrival may result in refusal of entry, with no rescheduling or refund. If late entry is granted, the Service duration may be reduced without partial or full refund.
2.6. Safety and health rules
The Venue may have specific health and/or safety requirements. Clients must follow the safety and health rules stated on the Salon’s product page and/or Ticket.
Cultival or Venue staff may refuse entry to anyone not complying with these rules or whose condition is deemed incompatible with the experience. No refund or compensation will be given.
The Venue and Cultival reserve the right to inspect bags and confiscate dangerous items without returning them. ID may also be required on site.
2.7. Unused or partially used Service
Any Service interrupted, shortened, or unused by the Client, for any reason, will not be refunded. Lost or unpresented Tickets will not be replaced or refunded. Late arrival or no-show is considered a cancellation without refund.
2.8. Cancellation and refund policy
No cancellation or modification is possible.
Weather conditions, strikes, demonstrations, traffic disruptions, and other force majeure events as defined in generals conditions do not constitute grounds for cancellation or refund.
The right of withdrawal under Article L.221-28(12) of the French Consumer Code does not apply to dated and/or timed services.
2.9. Unaccompanied minors
Participation by an unaccompanied minor is entirely at the responsibility of the person holding parental authority, whether or not they are present. This person must ensure the Salon content is appropriate for the minor and that the minor can be easily identified.
Unaccompanied minors must be able to present ID and an emergency contact number. If not, Cultival reserves the right to refuse entry.
